By scheduling services, signing a contract, making a payment, or using our website, you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use our services.
These terms apply to all services provided by Newberry Dog Training Co. LLC ("Trainer," "we," "us") to you ("Client," "you"). Additional terms specific to your program are outlined in your signed Service Agreement.
If you are scheduling or signing on behalf of a household, you represent that you have authority to bind all household members who will handle the dog.
Newberry Dog Training Co. LLC provides professional dog training services including:
Service details, duration, and pricing are specified in your Service Agreement and/or invoice.
Training results are not guaranteed. Dogs are living beings influenced by genetics, history, environment, health, and many factors beyond training alone.

We provide professional guidance and proven methods, but cannot promise specific behavioral outcomes.
Sessions and programs are scheduled in advance through our Client Portal or in writing. You are responsible for attending scheduled sessions on time.

If we need to cancel or reschedule a session, we will provide as much notice as possible and reschedule at no additional cost to you.
Sessions may be rescheduled due to severe weather or emergencies. We will notify you as soon as possible and work together to find a suitable alternative time.
Most programs require a non-refundable deposit at enrollment:
Deposits are credited toward your total program cost. The remaining balance is due according to your selected payment plan.
After your deposit, you may choose how to pay the remaining balance:
All installments must be paid according to schedule. Missing payments may result in suspension of services.
We accept payment via credit/debit card through our secure payment processor, Stripe. All payments are encrypted and processed according to PCI-DSS standards.
Program fees are non-refundable once services begin, except as required by law. This reflects the time, preparation, and scheduling that goes into each program.

Before services begin, you must provide proof of current vaccinations:
Your dog must be on current flea, tick, and heartworm prevention throughout the program.
You must disclose any:
Failure to disclose health information may result in termination of services without refund.
You must honestly disclose your dog's complete behavioral history, including:
This information is critical for safety planning. Misrepresentation of your dog's history is grounds for immediate termination without refund and may result in liability for any resulting damages.
We do not judge—we need accurate information to keep everyone safe and design an effective training plan.
Dog training involves inherent risks, including but not limited to:
By participating in training, you acknowledge and accept these risks.
You agree to release and hold harmless Newberry Dog Training Co. LLC, its owners, employees, and agents from liability for any claims, damages, or injuries arising from training services, except in cases of gross negligence or willful misconduct.
Our total liability for any claims arising from services shall not exceed the amount you paid for the program in question.
You agree to indemnify and hold us harmless from any claims or damages arising from your dog's behavior or your breach of this agreement.
You are responsible for any damage caused by your dog to Trainer property, equipment, facilities, or third-party property.
We may terminate services immediately if:
In cases of termination for cause, no refund will be issued.
You may terminate services at any time by notifying us in writing. No refunds will be issued for unused portions once services have begun, except as required by law.
We may photograph or record video of training sessions for:
Your media consent preference is specified in your Service Agreement. If you do not consent, we will not use images of your dog for public marketing purposes.
No compensation is provided for media use. You may revoke consent in writing at any time; revocation applies prospectively and does not require removal of previously published materials.
All training materials, methods, protocols, and content provided by Newberry Dog Training Co. LLC are our intellectual property or used under license. You may use materials provided for personal training of your own dog only.
You may not:
If a dispute arises, we agree to first attempt resolution through good-faith communication. Many issues can be resolved with a conversation.
If direct resolution is unsuccessful, we agree to attempt mediation before pursuing litigation. Mediation shall occur in Alachua County, Florida.
This agreement is governed by the laws of the State of Florida. Any legal action shall be brought in Alachua County, Florida.
These Terms & Conditions, together with your signed Service Agreement, constitute the entire agreement between you and Newberry Dog Training Co. LLC and supersede all prior agreements or understandings.
If any provision of this agreement is found unenforceable, the remaining provisions remain in full effect.
We may update these terms from time to time. Continued use of services after changes constitutes acceptance. Material changes will be communicated via email.
Notices may be sent via email to addresses on file. Notices to us should be sent to info@newberrydogtraining.com.
You consent to electronic contracts and acknowledge that electronic signatures carry the same legal effect as handwritten signatures.
