Terms & Conditions

By scheduling services, signing a contract, making a payment, or using our website, you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use our services.

These terms apply to all services provided by Newberry Dog Training Co. LLC ("Trainer," "we," "us") to you ("Client," "you"). Additional terms specific to your program are outlined in your signed Service Agreement.

If you are scheduling or signing on behalf of a household, you represent that you have authority to bind all household members who will handle the dog.

Newberry Dog Training Co. LLC provides professional dog training services including:

• Private Lessons: One-on-one coaching sessions for you and your dog
• Day Training: Trainer-led training during business hours, dog returns home at night
• Board & Train: Immersive programs where your dog stays with the trainer
• Group Classes: Structured classes with multiple dogs and owners

Service details, duration, and pricing are specified in your Service Agreement and/or invoice.

Training results are not guaranteed. Dogs are living beings influenced by genetics, history, environment, health, and many factors beyond training alone.

Results depend on:

• Your dog's individual temperament and learning style
• Your consistency in applying training protocols
• Regular practice and follow-through at home
• Accurate disclosure of behavioral history and health issues

We provide professional guidance and proven methods, but cannot promise specific behavioral outcomes.

Sessions and programs are scheduled in advance through our Client Portal or in writing. You are responsible for attending scheduled sessions on time.

Cancellation Policy

• 24+ hours notice: Sessions may be rescheduled at no charge
• Less than 24 hours notice: Session fee is forfeited and counts toward your program
• No-shows: Session fee is forfeited in full

Trainer Cancellations

If we need to cancel or reschedule a session, we will provide as much notice as possible and reschedule at no additional cost to you.

Weather & Emergencies

Sessions may be rescheduled due to severe weather or emergencies. We will notify you as soon as possible and work together to find a suitable alternative time.

Deposits

Most programs require a non-refundable deposit at enrollment:

• Board & Train / Day Training: $500 deposit
• Private Lessons: $100 deposit
• Group Classes: Full payment at registration (no deposit)

Deposits are credited toward your total program cost. The remaining balance is due according to your selected payment plan.

Payment Plans

After your deposit, you may choose how to pay the remaining balance:

• Pay in Full: Receive a 5% discount on your total program cost. Remaining balance due at program start.
• Split (2 Payments): Two equal payments — first at program start, second at the midpoint of your program.
• Split (3 Payments): Three equal payments — at program start, at the midpoint, and at the three-quarter mark of your program.

All installments must be paid according to schedule. Missing payments may result in suspension of services.

Payment Methods

We accept payment via credit/debit card through our secure payment processor, Stripe. All payments are encrypted and processed according to PCI-DSS standards.

Late Payments

• Payments are due on scheduled due dates with a 3-day grace period
• After the grace period, a one-time late fee of 2% of the overdue balance applies
• Services may be paused until payment is received
• Continued non-payment is grounds for termination

Program fees are non-refundable once services begin, except as required by law. This reflects the time, preparation, and scheduling that goes into each program.

• Board & Train deposits are non-refundable but may transfer to a future program within 6 months
• Unused sessions in packages cannot be refunded but may be rescheduled with proper notice
• Refunds, when approved, are processed within 5-10 business days

Required Vaccinations

Before services begin, you must provide proof of current vaccinations:

• Rabies (required by law)
• DHPP/DAPP (Distemper, Hepatitis, Parvovirus, Parainfluenza)
• Bordetella (Kennel Cough)

Parasite Prevention

Your dog must be on current flea, tick, and heartworm prevention throughout the program.

Health Disclosure

You must disclose any:

• Medical conditions, injuries, or chronic health issues
• Current medications or supplements
• Dietary restrictions or allergies
• Recent illness or exposure to contagious diseases

Failure to disclose health information may result in termination of services without refund.

You must honestly disclose your dog's complete behavioral history, including:

• Any bite history (bites to humans or animals)
• Aggression, reactivity, or fear-based behaviors
• Resource guarding (food, toys, spaces)
• Escape attempts or fence jumping
• Previous training or behavioral interventions

This information is critical for safety planning. Misrepresentation of your dog's history is grounds for immediate termination without refund and may result in liability for any resulting damages.

We do not judge—we need accurate information to keep everyone safe and design an effective training plan.

Assumption of Risk

Dog training involves inherent risks, including but not limited to:

• Dog bites, scratches, or other injuries
• Unpredictable animal behavior
• Injuries from equipment or handling
• Property damage
• Injury to other people or animals

By participating in training, you acknowledge and accept these risks.

Release & Hold Harmless

You agree to release and hold harmless Newberry Dog Training Co. LLC, its owners, employees, and agents from liability for any claims, damages, or injuries arising from training services, except in cases of gross negligence or willful misconduct.

Limitation of Liability

Our total liability for any claims arising from services shall not exceed the amount you paid for the program in question.

Indemnification

You agree to indemnify and hold us harmless from any claims or damages arising from your dog's behavior or your breach of this agreement.

Property Damage

You are responsible for any damage caused by your dog to Trainer property, equipment, facilities, or third-party property.

For Board & Train and Day Training programs, you authorize us to seek emergency veterinary care if your dog becomes ill or injured while in our care.

• We will contact you as soon as reasonably possible
• You are responsible for all veterinary costs, including emergency care, examination, treatment, and transport
• We will use your preferred veterinarian when possible, or the nearest available emergency facility

You may decline veterinary authorization in your Service Agreement, but understand this may limit our ability to respond to emergencies.

Termination by Trainer

We may terminate services immediately if:

• Payment is not received as agreed
• You misrepresented your dog's history or health
• You fail to follow safety instructions
• Conditions become unsafe for trainers, dogs, or others
• Your behavior is abusive, threatening, or disrespectful

In cases of termination for cause, no refund will be issued.

Termination by Client

You may terminate services at any time by notifying us in writing. No refunds will be issued for unused portions once services have begun, except as required by law.

We may photograph or record video of training sessions for:

• Training progress documentation shared with you
• Marketing and promotional purposes (website, social media, print materials)
• Educational content

Your media consent preference is specified in your Service Agreement. If you do not consent, we will not use images of your dog for public marketing purposes.

No compensation is provided for media use. You may revoke consent in writing at any time; revocation applies prospectively and does not require removal of previously published materials.

All training materials, methods, protocols, and content provided by Newberry Dog Training Co. LLC are our intellectual property or used under license. You may use materials provided for personal training of your own dog only.

You may not:

• Reproduce, distribute, or sell our training materials
• Use our methods to train dogs commercially without written permission
• Copy our website content, branding, or marketing materials

Good Faith Resolution

If a dispute arises, we agree to first attempt resolution through good-faith communication. Many issues can be resolved with a conversation.

Mediation

If direct resolution is unsuccessful, we agree to attempt mediation before pursuing litigation. Mediation shall occur in Alachua County, Florida.

Governing Law

This agreement is governed by the laws of the State of Florida. Any legal action shall be brought in Alachua County, Florida.

Entire Agreement

These Terms & Conditions, together with your signed Service Agreement, constitute the entire agreement between you and Newberry Dog Training Co. LLC and supersede all prior agreements or understandings.

Severability

If any provision of this agreement is found unenforceable, the remaining provisions remain in full effect.

Amendments

We may update these terms from time to time. Continued use of services after changes constitutes acceptance. Material changes will be communicated via email.

Notices

Notices may be sent via email to addresses on file. Notices to us should be sent to info@newberrydogtraining.com.

Electronic Signatures

You consent to electronic contracts and acknowledge that electronic signatures carry the same legal effect as handwritten signatures.
